SD High Court Considers Taxidermy Inspection Law

PIERRE, SD - The South Dakota Supreme Court has been asked to throw out a taxidermist's conviction for refusing to allow a game warden to inspect his records.

A lawyer for William Klager of Stratford told the Supreme Court on Tuesday that the state law allowing inspections of taxidermy shops violates the constitutional protection against unreasonable searches.

Attorney H.I. King says the law is flawed because it does not provide enough certainty that taxidermists will even be inspected, and it gives game wardens too much discretion in deciding when to conduct inspections.

A state lawyer says the law meets constitutional requirements.

Klager was convicted of a misdemeanor after refusing to let a game warden inspect his records.
