Lease Agreement

I may have an opportunity to lease some land from friends of a friend in SE Nebraska/NE Kansas. They have 130-160 acres they would like to lease for pheasant/quail and deer hunting. This is a so-so county for upland, and I would assume a pretty good deer hunting location. I have viewed it online and it appears to be 70-80% row crop, with a few drainage ways, tree lines and a little marsh area with cattails. I plan on checking the ground out within a week or so, but wanted to do my due diligence before meeting in person.

My question for all of you is, what is a good lease agreement for upland? Do you pay per bird, flat fee, etc.? How much? I don't deer hunt so I would only be interested in working on a deal to upland hunt.

I have hunted the area you speak of and agree about being so so bird numbers , hopefully with the tree lines etc there is decent quail hunting . I have a over 1000 acres I could hunt in that area but do to all the cover taken out in the last decade choose to go elsewhere .

I would work a deal for upland lease and if there in a mind to do a separate rifle deer season lease with someone else it would only be for two weekends .

I would inquire about the two state's walk-in hunting programs and offer to pay a little more than they do , otherwise I would offer to help fix fence spray trees or weeds instead of a lease .

When I lived in Nebraska I hunted quite a bit down in the Falls City area, mainly for deer, which you have indicated is primary game. I imagine there will be some turkeys, quail and few pheasants. I would think paying an amount close to the owners property taxes would be a good arrangement. A lot depends on the amount of game on the property, if trespassers are kept off and you have exclusive rights to the place. I have brothers who still hunt down this way, it is a very popular area and leases are becoming more and more common.
 
I had a landowner suddenly want money to hunt his land that I had been hunting for 21 years at no cost with permission of his longtime lessee who is a friend of mine. I met with him and his wife, all very friendly, and said I would prefer to make a single lump sum payment to hunt just upland birds and turkeys. He thought that was OK but didn't know how much he wanted. I sat there thinking for a minute and then made him an offer. He accepted. Done deal.

From others I understand that deer hunting rights can get pricey. My cousin gets a pretty penny from his deer hunters.

Someone mentioned trespassers. Many times a farmer wants to lease out hunting rights so they don't have to worry about keeping trespassers off or having folks come ask for permission. He might put up a sign that says "Leased Hunting, no trespassing allowed" and call it good.

What I am saying, I wouldn't necessarily depend on the landowner to keep others off. And locals don't like to see those signs.

If you're paying to hunt, I would ask the owner to be allowed to post the land if it is not - do it yourself rather than asking the owner.
 
Follow up: Unfortunately, the ground didn't have much for birds or bird habitat. Planning to work with the farmer in the future to help get some habitat back in the field, and hopefully hunt it one day.
